Many people do not realize that business owners may be held
responsible for criminal incidents that occur on their property.
Business owners are also legally responsible for injuries that
result from dangerous conditions on their property.
Premises Liability
Premises liability refers to legal claims arising out of injuries
that occur on property that has been improperly designed, constructed
or maintained or is otherwise in a dangerous or unsafe condition.
Property owners, including business owners, have a legal duty
to maintain their property in a reasonably safe condition, and
to warn the public about any dangerous conditions existing on
the property. Similarly, contractors who are working on the
property are required to perform their work in a reasonable
and prudent manner.
When a person is injured by a dangerous property condition,
he or she may have a legal cause of action. JMP attorneys have
handled a wide variety of premises liability claims, and are
prepared to assist you with claims arising under the following
situations:
- Injuries arising out of improper design, construction
or maintenance of porches, stairs, pools, propane lines
and other structures.
- Dog bites and other animal attacks
- Injuries caused by intoxicated drivers who were served
excessive alcohol, either at a bar, restaurant or private
home.
- Injuries, including drownings, that occur in pools, ponds
or other water enclosures
- Injuries occurring on unguarded, unsecured or unsafe
construction sites
- Failure to warn of dangerous conditions, including holes,
sources of high voltage electricity and unguarded machinery.
- Negligent supervision of children on the property.
